Please read these Terms and Conditions ("Terms") carefully before engaging with Linden Photography. These Terms govern your use of our wedding photography services, website, and any other related interactions. By engaging our services or using our website, you acknowledge that you have read, understood, and agree to be bound by these Terms.

  1. Services and Payment:

    • Photography Services: We provide photography services as agreed upon in our contract or as per the terms discussed.

    • Pricing and Payment: The pricing for our services will be communicated to you in advance. A deposit or full payment may be required to secure our services. Payment terms and methods will be outlined in our agreement or as otherwise agreed upon.

  2. Booking and Cancellations:

    • Booking: A booking is considered confirmed upon receipt of a signed contract and payment of the required deposit.

    • Cancellations by Client: If you need to cancel or reschedule your wedding photography session, please provide us with reasonable notice. Any payments made may be subject to our cancellation policy, which will be outlined in our agreement.

    • Cancellations by Linden Photography: In the event that we are unable to fulfill our obligations due to unforeseen circumstances, we will make every effort to provide a suitable alternative or refund any payments made.

  3. Intellectual Property:

    • Ownership: Linden Photography retains all rights, title, and interest in the photographs and other materials created during the provision of our services, including but not limited to digital files, prints, and albums.

    • Usage Rights: Upon full payment, clients are granted a limited, non-exclusive license to use the photographs for personal, non-commercial purposes. Clients are not permitted to sell, modify, or use the photographs for any commercial purposes without our prior written consent.

  4. Client Cooperation and Responsibilities:

    • Cooperation: Clients agree to provide necessary cooperation and assistance to ensure the successful provision of our services. This includes but is not limited to:

      • Communication: Clients will promptly and accurately communicate their requirements, expectations, and any specific details related to wedding photography services. This includes providing us with a detailed shot list, specific instructions, and any special requests or considerations.

      • Availability and Timeliness: Clients will be present at the agreed-upon times and locations for the photography sessions. It is the responsibility of the clients to ensure their availability and punctuality, as any delays or missed sessions may affect the quality and coverage of the photographs. 

      • Venue and Vendor Information: Clients will provide us with the necessary information regarding the wedding venue and other relevant vendors involved in the event. This includes sharing any restrictions, guidelines, or special considerations set by the venue or other vendors that may impact our photography services.

    • Venue and Vendor Restrictions:

      • Clients acknowledge that certain venues or vendors may have specific policies or restrictions regarding photography. It is the responsibility of the clients to obtain any necessary permissions, permits, or clearances required for photography at the wedding venue or other relevant locations.

      • Clients will inform us in advance of any venue or vendor restrictions that may affect the provision of our services. This includes any limitations on equipment, access, or photography style imposed by the venue or vendors.

    • Consent and Cooperation of Subjects:

      • Clients are responsible for obtaining any necessary consents or permissions from individuals who will be subjects of the photographs. This includes ensuring that all relevant parties are aware of and agree to the photography services and the intended use of the photographs.

      • Clients will notify us in advance of any specific sensitivities, privacy concerns, or preferences related to photographing certain individuals or groups.

    • Professional Conduct:

      • Clients will treat our photographers and staff with respect and professionalism throughout the engagement. Any inappropriate behavior, harassment, or misconduct toward our team members will not be tolerated.

      • Clients understand and agree that our photographers will use their professional judgment and expertise in capturing and selecting photographs. While we welcome client input and preferences, the final artistic decisions regarding composition, lighting, editing, and image selection will be made by our photographers.

    • Delivery and Feedback: 

      • Clients will provide timely feedback and approvals on the selection of photographs, albums, prints, or any other deliverables requiring client input. Any delays in providing feedback may result in a delay in the delivery of the final products.

      • Clients are responsible for reviewing the final products promptly upon receipt and notifying us within a reasonable time of any concerns or issues. We will work to address any valid concerns in a timely manner.

    • Client Privacy:

      • We respect the privacy of our clients and the individuals involved in the photography sessions. We will take reasonable measures to protect the privacy and confidentiality of the photographs and personal information shared with us.

      • Clients understand and agree that, with their consent, we may showcase a selection of the photographs in our portfolio, website, social media, or other promotional materials. However, we will not disclose any personal information or sensitive details without explicit permission.

      • Clients have the right to request the removal of their photographs from our promotional materials or online platforms by providing a written request to us.

  5. Limitation of Liability:

    • We will take reasonable measures to ensure the quality and timely delivery of our services. However, we shall not be held liable for any delays, interruptions, or failures due to circumstances beyond our reasonable control.

    • Our liability for any direct damages arising out of or in connection with our services shall be limited to the total amount paid by the client for those services.

    • We shall not be liable for any indirect, consequential, or incidental damages, including but not limited to lost profits or loss of data.

  6. Governing Law and Jurisdiction:
    These Terms shall be governed by and construed in accordance with the laws of the United Kingdom. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of the United Kingdom.

  7. Modifications to Terms:
    We reserve the right to update or modify these Terms at any time. Any changes will be effective upon posting on our website. It is your responsibility to review these Terms periodically for any updates.
